CoreCast Terms and Conditions

1. Introduction

Welcome to CoreCast! These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and digital content (collectively, the “Services”). By using our Services, you agree to be bound by these Terms, which form a legally binding agreement between you and CoreCast. If you do not agree to these Terms, please do not use our Services. “CoreCast” (referred to in these Terms as “CoreCast”, “we”, “us”, or “our”) is a brand under which fitness and wellness services are provided. These services are currently delivered by Anthony Guidera (the “Provider”), operating either in their individual capacity or through an existing single-member LLC. CoreCast is not a formal legal entity at this time, and any references to “CoreCast” in this document refer to the Provider and their authorized operations under this brand name.

By booking or participating in any Services through the CoreCast website or scheduling platform, you acknowledge and agree that all Services are provided by the Provider and that no separate legal entity named “CoreCast” exists at this time.

CoreCast reserves the right to update or modify these Terms at any time, and such changes will be effective upon posting. Your continued use of the Services after such posting constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to access or use CoreCast’s Services. By using the Services, you represent and warrant that you are 18 years of age or older.

Our Services are intended to be accessible worldwide. However, you are solely responsible for ensuring that your use of the Services complies with all laws, regulations, and rules applicable in your jurisdiction. If access to or use of the Services is illegal or prohibited in your country, you must not access or use them.

By using the Services, you affirm that you are physically and medically capable of engaging in fitness activities. You acknowledge that participation in any exercise or fitness program carries inherent risks, and you agree to assume full responsibility for your health and safety while using our Services. We strongly recommend consulting with a physician before beginning any new exercise program.

3. Services Provided

CoreCast offers a range of fitness services, including but not limited to live one-on-one training sessions, virtual and in-person group classes, and access to on-demand fitness courses and programs. In the future, certain services may be offered in-person at designated physical locations, and these will be subject to additional terms, conditions, and safety requirements which will be communicated at the time of booking. These services may be accessed through our website and associated platforms.

To use certain features of the Services, you may need a compatible device and internet access. CoreCast is not responsible for any limitations resulting from your hardware, software, or internet connectivity.

We reserve the right to modify, enhance, or discontinue any aspect of our Services at any time without prior notice. This includes the addition or removal of features, programs, or content. CoreCast shall not be liable for any modification, suspension, or discontinuation of the Services.

4. Account Registration and Security

To access certain features of the Services, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate and complete.

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activities that occur under your account. You agree to notify CoreCast immediately of any unauthorized use of your account or any other breach of security.

CoreCast reserves the right to suspend or terminate your account, or restrict your access to certain parts of the Services, at our sole discretion and without liability, if we suspect any unauthorized use or misuse of your account, or if you violate these Terms or applicable laws.

5. Payment and Billing

Certain features of the Services may require payment. You agree to pay all applicable fees and charges, including any applicable taxes, in accordance with the pricing and billing terms presented to you at the time of purchase. All payments must be made through our authorized payment processor.

Some Services may be offered on a subscription basis with automatic renewal. By subscribing, you authorize CoreCast to charge your payment method on a recurring basis until you cancel. You can cancel a subscription at any time, but no refunds will be issued for partial subscription periods unless required by law.

Refund eligibility for non-subscription purchases, such as class packs or courses, will be governed by CoreCast’s posted refund policy at the time of purchase. Generally, once digital content is accessed or a session is attended, refunds may not be available.

You are responsible for ensuring that your payment information is accurate and up to date. CoreCast is not responsible for any overdraft fees or other charges imposed by your bank or payment provider.

6. Cancellation and Termination

User-Initiated Cancellation: You may cancel your account or any ongoing subscription at any time through your account settings or by contacting CoreCast support. Please note that cancellation does not entitle you to a refund unless otherwise specified in our refund policy.

CoreCast’s Right to Terminate: We reserve the right to suspend, disable, or terminate your access to the Services, or any portion thereof, at our sole discretion, at any time and without prior notice, if we believe you have violated these Terms, misused the Services, or if your conduct may harm CoreCast, its users, or third parties.

Effect of Termination: Upon termination or suspension of your access to the Services, your right to use the Services will immediately cease. Any data associated with your account may be deleted, and CoreCast will have no obligation to maintain or provide access to such data unless required by law.

7. Use Restrictions

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services in any way that violates any applicable federal, state, local, or international law or regulation;

  • Reproduce, distribute, publicly display, or otherwise exploit any portion of the Services for commercial purposes without prior written consent from CoreCast;

  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein;

  • Attempt to gain unauthorized access to the Services, other user accounts, or computer systems or networks connected to the Services;

  • Upload or transmit viruses, worms, Trojan horses, or other harmful code;

  • Engage in any activity that could disable, overburden, damage, or impair the proper working of the Services.

CoreCast reserves the right to investigate and take appropriate legal action against anyone who, in CoreCast’s sole discretion, violates this Section, including terminating or suspending the account of such violators.

8. Intellectual Property

All content, features, and functionality included in the Services—including but not limited to text, graphics, logos, images, audio, video, software, and the overall design—are the exclusive property of CoreCast or its licensors and are protected by applicable intellectual property laws.

CoreCast grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Services without prior written permission from CoreCast.

All trademarks, logos, and service marks displayed on the Services are the property of CoreCast or third parties. You may not use any such marks without the prior written consent of the respective owner.

Unauthorized use of any materials contained on the Services may violate copyright, trademark, and other laws and could result in criminal or civil penalties.

9. Health and Safety Disclaimer

The fitness content and training services provided by CoreCast are intended for general informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment.

By using the Services, you acknowledge and agree that:

  • You are solely responsible for your health and wellness decisions.

  • You have consulted with a physician or are otherwise medically cleared to participate in physical activity.

  • You understand the inherent risks associated with physical exercise, including risk of injury, illness, or death.

CoreCast, its instructors, and its affiliates are not responsible for any injuries or health conditions that may result from your participation in any activity offered through the Services. You voluntarily assume all risks associated with your use of the Services.

10. Limitation of Liability

To the fullest extent permitted by law, CoreCast and its affiliates, officers, employees, agents, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use the Services;

  • Any conduct or content of any third party on the Services;

  • Any content obtained from the Services;

  • Unauthorized access, use, or alteration of your transmissions or content.

The Services are provided on an “as is” and “as available” basis. CoreCast makes no warranties or representations, express or implied, about the accuracy, reliability, availability, or suitability of the Services for any purpose. Your sole and exclusive remedy for dissatisfaction with the Services is to stop using them.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless CoreCast, its affiliates, officers, directors, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Services;

  • Your violation of these Terms;

  • Your violation of any third-party rights, including intellectual property or privacy rights;

  • Any claim that your use of the Services caused damage to a third party.

CoreCast reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with CoreCast in asserting any available defenses.

12. Privacy

CoreCast is committed to protecting your privacy. We provide the following information regarding our data practices:

  • We collect only the personal information necessary to provide and improve our Services. This may include your name, email address, and payment details when you sign up or make purchases, as well as information you voluntarily provide that supports training goals or performance tracking.

  • Your information is used solely for purposes related to account management, communications, service personalization, training support, and customer service.

  • We do not sell or share your personal information with third parties for marketing purposes.

  • Payment processing is handled by secure third-party providers; CoreCast does not store your full payment details.

  • We implement reasonable technical and organizational measures to protect your information.

13. Third-Party Services

The Services may include links to or integrations with third-party websites, applications, or services (“Third-Party Services”) that are not owned or controlled by CoreCast. These are provided for your convenience only.

CoreCast does not endorse or assume any responsibility for the content, policies, or practices of any Third-Party Services. If you access a Third-Party Service through our Services, you do so at your own risk and you understand that these Terms do not apply to your use of those services.

You acknowledge and agree that CoreCast shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through any such Third-Party Services.

14. Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in King County, Washington, unless both parties agree otherwise.

Each party shall bear its own costs, including legal fees, unless the arbitrator determines otherwise under applicable law. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or enjoin infringement or misappropriation of intellectual property rights.

You and CoreCast agree to resolve any disputes individually and not on a class or collective basis. You waive any right to a jury trial or to participate in a class action lawsuit.

15. Miscellaneous

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

These Terms, together with our refund policy and any other legal notices published by CoreCast, constitute the entire agreement between you and CoreCast concerning your use of the Services.

No waiver by either party of any breach or default under these Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from CoreCast. CoreCast may assign or transfer its rights without restriction.
